While riding his motorcycle near Winter Haven, Florida, E.H. alleged that a piece of wood flew off a dump trunk traveling in the opposite direction, causing him to fall off his motorcycle and be knocked unconscious. E.H. alleged that the driver, who was on his way to a landfill, was carrying a load of debris without a tarp over the back, which violated the state law. E.H. was taken by ambulance to the emergency room, where an MRI was administered. The client sustained a cut to his head, which was closed with staples. In addition, he also sustained bilateral carpal tunnel sysndrome plus back, neck and shoulder injuries. E.H.’s treating osteopath testified that E.H.’s neck and back injuries would persist and that they would rquire future medical care. The defendant’s orthopedic surgery expert performed an independent medical exam and opined that E.H. had achieved maximum improvement and would require any future medical care. E.H. was awarded a verdict of $15,000 for damages.
