J.S. was stopped in rush hour traffic when he saw the semi-tractor bearing down on him. He braced for impact, heard the brakes of the truck squealing, and felt the jarring impact. He immediately felt pain in his shoulder and back. After reaching maximum medical improvement, J.S. continued to have back pain, but mostly he complained of ongoing shoulder pain and reduced strength and reduced range of motion. A claim was made against the negligent truck driver’s insurance company. However, due to the relatively minor property damage that resulted to both vehicles, the defendant denied causing the client’s shoulder injury and pain, and soft tissue back pain. The client ultimately underwent surgery on his shoulder. The defendant removed the case from state court to the Federal District Court, Middle District of Florida for trial. After months of litigation, discovery and final preparations for trial before the Federal Court, the attorney was able to obtain $145,000 for the client at mediation. The surgery was successful and J.S. was able to move on with his daily life activities free of painful restrictions in his shoulder.
