On January 21, 1999 , our client was working as an independent contractor for a company and fell over 15 feet and sustained many serious injuries, including a life altering head injury. Under the control and supervision of the company’s personnel, our client was raised 19 feet in the air in a homemade cage to install lights. The homemade cage collapsed, causing our client to fall over 15 feet. He hit his head on a metal tank before landing on the concrete floor. Our client sustained injuries to his head, knees, shoulder, neck and back. The severity of the head injury completely removed our client from the work force. The company was placed on notice to preserve the homemade cage for future inspection by experts. It was later discovered that an employee of the company had discarded the evidence. After brief negotiations, the company settled the claim with our client for $750,000, prior to a lawsuit being filed in Circuit Court.
