The U.S. Consumer Product Safety Commission (CPSC) has reached a settlement with Burlington Coat Factory Warehouse Corp. of New Jersey after the company agreed to pay a $1,500,000 civil penalty for failure to report their sale of various children’s garments with drawstrings around the neck. By not reporting the sale of these items, the company violated federal law that requires manufacturers, distributors, and retailers to notify the CPSC that a product may contain a defect that potentially creates a significant product hazard.
Children’s upper garments with drawstrings such as jackets, sweatshirts, and sweaters pose an entanglement and strangulation hazards than can possibly result in serious injury or death. The CPSC first issued guidelines regarding drawstrings in children’s garments in 1996, which became voluntary industry standards in 1997. In 2006, the agency announced these garments to be considered defective. Five years after a federal regulation was put into place defining the exact range of sizes in which drawstrings would not be allowed.
The garments that led to the penalty were sold by Burlington Coat Factory were sold nationwide, and are listed below.
