What is the process in terms of bringing a workers compensation claim once an accident has occurred on the job? Hello, I’m Lawrence Anzalone. I’m one of the attorneys at Burnetti P.A. I specialize in the area of workers’ compensation law.
As soon as practicable, you should contact your employer and advise them what took place, who was there, who witnessed it, how it happened, when it happened, and what problems you are currently having. It’s also advisable to tell them that you need to see a doctor, assuming you do at that point in time.
If you find out that you later have a problem that is manifesting itself in a more serious way, you can either go to the emergency room, if that’s the case, or contact your employer and advise them at that time that you are in need of a doctor.
It’s very important to remember that there is a notice requirement in Florida. That notice is generally thirty days. However, depending on the circumstances of the accident, it may be emergent, it may be urgent, and it may manifest itself at a later point in time. Once your employer has been given notice, they have a requirement to offer you medical care. Please avail yourself of that if it’s necessary.
The point is you need to establish that there is a problem and what that problem is and seek appropriate medical care so that in the future your medical needs will be addressed.
