I have been asked by many of my clients whether they will be fired if they file for workers’ compensation. My name is Lawrence Anzalone and I practice workers’ compensation law in Central Florida for the law firm of Burnetti, PA.
Generally speaking, an employer will not fire you if you file for workers’ compensation. The problem with a termination is that the termination may be deemed a retaliatory discharge. Retaliatory discharge is a separate lawsuit that can be brought in circuit court by the injured worker.
The penalties and the damages for such an action generally are not worth it for the employer to do so.
So, though they can, they generally won’t, in spite of the fact that Florida is a right-to-work state. In summation, the employer can terminate the relationship, but they probably won’t.
